1. Who we are and scope
Upshift Web Studio is owned and operated by JD Ventures, LLC, a Connecticut limited liability company based in Glastonbury, Connecticut. “Upshift,” “we,” “us,” and “our” refer to JD Ventures, LLC operating Upshift Web Studio.
This policy explains how we handle personal information in connection with upshiftweb.com, project inquiries, communications, and our administration of prospective and existing client relationships. It is the specific privacy notice for Upshift Web Studio; other JD Ventures properties may have separate notices.
Client-owned websites and services have their own privacy notices. When we process information on a client's behalf under that client's instructions, the applicable client agreement and data-processing terms govern that work, subject to applicable law. Requests concerning a client's customers should generally be directed to that client. A client agreement does not remove individuals' rights under applicable privacy law.
2. Information you provide
We receive information when you complete an inquiry form, email us, discuss a project, or work with us. Depending on the interaction, this may include:
- Your name, business name, email address, phone number, and preferred contact method.
- Your current website, business type, service interests, package or budget preferences, and project description.
- Correspondence, proposals, agreements, feedback, support requests, and materials you choose to provide.
- Business contact, billing, invoice, payment-status, and transaction records needed to administer an engagement.
The inquiry form identifies required and optional fields. A phone number is required if you select phone as your preferred contact method. You can also contact us directly by email.
Payment arrangements are handled separately from this website through an agreed method, which may include an external payment processor or check. We may receive billing and transaction records associated with those payments. Do not send payment card details through the website inquiry form.
3. Technical information and website technologies
Our website and its hosting, security, and form providers may process technical information such as IP address, browser and device information, requested pages, referring website or page, request times, approximate location, error information, and security signals. The information processed varies by service and purpose.
We use website traffic and performance measurement, including Cloudflare Web Analytics and hosting/network analytics. Cloudflare Web Analytics uses a browser beacon without analytics cookies or localStorage; hosting and security services may separately process request and security information.
Our inquiry form uses SplitForms to receive and deliver submissions and measure form use. Form analytics can record visits, field interactions, and completion using a temporary session reference. Partial-lead capture is currently disabled: we do not use that feature to save answers from unfinished inquiries. Submitted inquiries and related technical information are processed by the form provider and delivered to our email system.
We use Cloudflare Turnstile to help detect automated submissions. It processes technical signals, including IP address and browser-related information, for bot detection and security. Cloudflare also describes its processing to improve Turnstile in its Turnstile Privacy Addendum.
The website also requests fonts from an external font service. Such requests disclose technical connection information, including the visitor's IP address, to that service.
See our Cookie Policy for more information about browser technologies and controls. Named services describe the current implementation. We may replace providers performing the same disclosed functions; material changes to our information practices are handled as described in Section 12.
4. How we use information
We use information as reasonably needed to:
- Respond to inquiries, evaluate project fit, and discuss services.
- Prepare proposals and agreements; deliver, administer, and support client projects.
- Manage communications, invoicing, payments, and business records.
- Operate, maintain, troubleshoot, secure, and improve the website and inquiry process.
- Understand traffic, website performance, and form completion.
- Send relevant information about Upshift and related JD Ventures business services, subject to applicable marketing requirements and your choices.
- Detect spam, fraud, misuse, and security incidents.
- Comply with legal, tax, accounting, and contractual obligations; resolve disputes; and establish, exercise, or defend legal rights.
AI-assisted tools may support business tasks such as reviewing project requirements, drafting communications or content, and developing or supporting work. Where we use such tools with information relating to an inquiry or engagement, relevant information may be processed by the tool provider for those tasks, subject to applicable law and our contractual obligations. This policy does not authorize uses that require separate consent or override confidentiality or data-processing commitments in a client agreement.
5. How information is disclosed
We may disclose information to the following recipients for the purposes described in this policy:
- Operational providers: Hosting, infrastructure, security, form processing, analytics, font delivery, email, communications, storage, and business software providers. Depending on their role, they may process technical information, contact details, communications, or project records.
- Project support: Contractors, collaborators, or specialized service providers, including AI-assisted software providers, where engaged to support the relevant work and given information appropriate to that role.
- Billing and professional support: Payment, invoicing, accounting, legal, insurance, and other professional service providers, as relevant to the transaction or advice.
- Legal and protective disclosures: Authorities or other parties when reasonably necessary to comply with law or valid legal process, address fraud or security issues, or protect lawful rights and safety.
- Business transactions: Parties involved in a proposed or completed merger, acquisition, financing, restructuring, or transfer of business assets, subject to applicable confidentiality and legal requirements.
- Your directions: Other recipients when you instruct us to disclose information or provide applicable consent.
JD Ventures operates Upshift as part of the same legal entity. Information may be handled internally to administer the business and for the purposes described here. We do not sell inquiry or client contact information for money. Permission to contact you about our services is not permission for unrelated third parties to market to you independently.
6. Marketing choices
You may ask us to stop promotional communications by using an unsubscribe option provided in a message or emailing legal@jdventureshq.com. We will honor opt-out requests as required by law. We may retain limited information needed to record and respect your preference.
An opt-out from marketing does not prevent necessary communications about an active inquiry or engagement, invoices, requested support, legal matters, or security. We obtain any consent required for a particular marketing channel; submitting a project inquiry is not, by itself, consent to automated marketing calls or texts.
7. Retention
We retain personal information for as long as reasonably necessary for the purposes described in this policy, including responding to inquiries, maintaining relevant business relationships, fulfilling and supporting projects, keeping tax and accounting records, addressing security issues, complying with legal or contractual obligations, and resolving disputes.
Retention depends on the type and sensitivity of the information, the relationship or project involved, the purpose for which it is needed, applicable requirements, and any relevant claim or dispute. We review whether information remains necessary and delete or de-identify it when it no longer serves a legitimate retention purpose, subject to applicable requirements and backup cycles.
A provider's retention period may differ from ours. For example, expiration of a submission in a form service does not necessarily delete the corresponding email, project file, or business record. Backup copies may remain until overwritten or deleted through the relevant backup cycle.
8. Security and sensitive information
We use reasonable safeguards appropriate to the information and services involved. No transmission, storage system, or security measure can be guaranteed completely secure.
Please do not include passwords, government identification numbers, financial account credentials, payment card details, medical or patient records, or other sensitive or regulated information in a website inquiry. If an engagement requires sensitive information or access to client systems, appropriate arrangements must be agreed separately before that information is provided.
9. Privacy requests and browser signals
You may contact legal@jdventureshq.com to ask about our handling of your information or request access, correction, or deletion. Depending on your location and the laws applicable to the information and our business, you may also have rights to obtain a portable copy, learn about certain disclosures or recipients, object to or restrict processing, withdraw consent where processing relies on it, or opt out of certain sales, sharing, targeted advertising, or profiling.
Rights are subject to applicable conditions and exceptions. We may need information reasonably necessary to verify your identity and any authorized agent's authority. We will respond within applicable legal deadlines and will not unlawfully discriminate against you for exercising protected rights. Where we cannot fulfill a request, we will explain as required by law.
If applicable law gives you a right to appeal a decision, email legal@jdventureshq.com with the subject “Privacy Appeal” and identify the request and reason for your appeal. We will review and respond as required by that law. You may also complain to the relevant regulator, including the Connecticut Attorney General, where appropriate.
Our website does not currently change its behavior in response to legacy “Do Not Track” browser signals. We have not configured advertising pixels on this website to track visitors across unrelated websites for targeted advertising. Service providers may nevertheless process technical information for the functions described above. Where applicable law requires us to honor a recognized universal opt-out signal, such as Global Privacy Control, we will apply it to the covered processing. A marketing opt-out can also be sent directly to our legal email address.
10. Age and geographic scope
Our services and inquiry features are intended for adults age 18 or older, primarily in the United States. We do not knowingly solicit personal information from children under 18 through those features. If you believe a child has provided information, contact us so we can assess and take appropriate action, including deletion where required.
We operate in the United States. Information may be processed in the United States and other locations where our providers operate, where privacy laws may differ. Where applicable law requires safeguards for an international transfer, those requirements apply; visiting the website does not waive your legal rights or substitute for any required transfer mechanism.
11. External websites
Links may take you to independent websites, payment services, or other providers. Their handling of information is governed by their own privacy notices. Review those notices before providing information directly to them. This does not remove our responsibilities for processing carried out on our behalf.
12. Changes to this policy
We may update this policy to reflect changes to the business, website, providers, information practices, or law. We will post the revised version with an updated effective date. For material changes, we will provide additional notice and obtain consent where required before implementing the relevant change. An updated policy does not by itself authorize materially different uses of previously collected information where further notice, consent, or another legal requirement applies.
